Limited Liability

The Client agrees that any material submitted for publication will not contain harmful, abusive, or unlawful content. This includes, but is not limited to:

  • Spamming
  • Intellectual property infringement

The Client agrees to indemnify and hold the Service Provider harmless from any claim resulting from the Client’s use or distribution of such materials. The Service Provider will not publish content that could be used to harm any individual, business, or entity. The Service Provider also does not create or distribute pornographic, harmful, or illegal software or content. The Service Provider reserves the right to determine what content is considered inappropriate.

Indemnification

The Client agrees to defend, indemnify, and hold the Service Provider harmless from any claims, liabilities, losses, costs, or expenses—including reasonable attorney fees—arising from the Client’s use of the Service Provider’s services. This includes, but is not limited to:

  • Claims related to products or services sold or distributed through the Client’s website
  • Injury to individuals or damage to property caused by the Client’s products or services
  • Copyright or trademark infringement
  • Violation of proprietary rights
  • Misrepresentation, defective products, or misleading information

Under no circumstances, including negligence—shall the Service Provider, its officers, agents, employees, subcontractors, or anyone involved in delivering the service be liable for damages resulting from:

  • Use or inability to use the service
  • Errors, omissions, or delays in operation
  • File loss or corruption
  • Transmission failures
  • Unauthorized access
  • Service interruptions

All such risks are assumed by the Client.
